DEPOSITS: An event is not confirmed until a deposit is paid and contract is signed. Deposits may be waived at the discretion of The Palms Banquets, however a signed contract is required. Without the required deposit and signed contract, dates are not considered confirmed. A minimum deposit of $500 is essential to hold your date. Deposits are non-refundable and non-transferable unless there are special arrangements made in writing with The Palms Banquets. Banquet rooms are held tentatively for a period of 10 (ten) days. In order to maintain low prices, a fee of 1.5% must be charged for the use of all credit cards (except 3.5% for American Express) when used for payment of deposits.

CANCELLATIONS: If it should become necessary for the engager to cancel the event, The Palms Banquets must be notified immediately and a Cancellation Agreement signed. While the deposits are non-refundable, in the event of any unpleasant family circumstances, certain modifications may be allowed at the discretion of the management.

PRICES: The quotations are valid for 90 days and are subject to a 10% increase after that time period. Increase will however be limited to $2.00 per person. If there is a dramatic change in the cost of any item for your event, The Palms Banquets will give you the opportunity to make an alternative selection. Special negotiated packages are subject to change when estimated attendance is considerably below the projected attendance (by more than 10%). A 18% service charge and an 8.75% NYS sales tax (subject to change) will be added to your bill.

ROOM RENTALS/OTHER CHARGES: Room rentals may be charged for use of rooms with or without food and beverage service at the discretion of The Palms Banquets based on the requirements for the particular event. We may or may not charge for additional items such as linen, AV equipment or decorating items at the discretion of The Palms Banquets. All charges will be outlined prior to the event and the engager will be given ample opportunity to amend or change the requirements accordingly.

In addition, if the function is scheduled to begin at a particular time and is considerably delayed, and/or runs considerably longer than the contracted ending time, additional charges for room rental, service, equipment or other additional expenses may be assessed.

GUARANTEES: Minimum Guarantees are stated in dollar amounts and are binding for all rooms and events unless otherwise stated in writing by The Palms Banquets. If the final total for FOOD and BEVERAGE falls below the Minimum Guarantee, the difference becomes a room rental charge and will be billed accordingly.

ROOM ASSIGNMENTS: The Palms Banquets reserved the right to substitute an alternate function room should the projected attendance for an event fall considerably below the original estimate for the function, or in the event of an unforeseen dilemma.

ROOM ARRANGEMENTS AND MENU SELECTION: Arrival times, meal times and other preferences are given based on date of deposit. A room diagram will be provided to the engager prior to the function, and The Palms Banquets reserves the right to charge an appropriate fee for set-up, break-down or clean-up of a function with unexpected requirements.

OUTSIDE FOOD AND BEVERAGE: Alcoholic beverages may not be brought into The Palms Banquets from any outside source. Non-alcoholic beverages and/or food from outside sources may not be brought into the facility without the expressed written consent of the management.

ALCOHOL CONSUMPTION: The Palms Banquets reserves the right to refuse to serve any person who does not show proper ID, or who appears to be impaired beyond bartender's comfort. The Palms Banquets does not assume responsibility for any guest or guests who may have been given access to alcohol by any other guest.

LIABILITY: The Palms Banquets does not assume responsibility for any merchandise or articles left in the banquet rooms, coat rooms, foyer or rest rooms, prior to, during or following an event. The Palms Banquets employees cannot be held personally responsible for any issues or incidents occurring prior to, during or following any event.

DAMAGE TO THE FACILITY: The Palms Banquets reserves the right to inspect and control all private functions. Liability for excessive clean-up or damage to premises or equipment will be charged accordingly. No tape or tacks may be used on the walls, NO CONFETTI, glitter, tinsel or other debris can be used by the engager or guests. The charge for clean-up for confetti will be $50.

FINAL COUNTS: The engager is required to notify The Palms Banquets of the exact number of guests attending at least 10 (ten) days before the function. This will be considered the guaranteed amount for which you will be charged, even if fewer guests attend. If you do not provide a final count for the function 10 (ten) days prior, you will be charged for the original estimated number of guests. A head count will be taken during the event and the engager will be billed appropriately for guests over and above the guaranteed amount.

FINAL PAYMENT: Final payment in full is expected in the form of certified check, cashier's check, money order or cash, three business days prior to the function unless other arrangements have been made with The Palms Banquets. We DO NOT accept personal checks for final payment. In order to maintain low prices, a fee of 1.5% must be charged for the use of all credit cards (except 3.5% for American Express) when used for making final payments.

THIS AGREEMENT CONTAINS THE ENTIRE UNDERSTANDING OF THE PARTIES AND SUPERCEDES ANY AND ALL PRIOR WRITTEN OR VERBAL AGREEMENTS.
